1. Introduction and Acceptance of Terms

These Terms and Conditions (“Terms”) govern access to and use of Cyber Samachar (“Cyber Samachar”, “Platform”, “Company”, “we”, “our”, or “us”), including its website, applications, digital publications, communication systems, reporting utilities, cybersecurity resources, APIs, newsletters, social media channels, technical blogs, investigative reports, editorials, databases, and associated services.

By accessing, browsing, using, interacting with, contributing to, or relying upon any part of the Platform, the user (“User”, “you”, or “your”) acknowledges that they have read, understood, and agreed to be legally bound by these Terms together with all applicable policies, notices, disclaimers, and operational guidelines published by Cyber Samachar from time to time.

If you do not agree with these Terms, you must immediately discontinue use of the Platform.

These Terms constitute a legally binding electronic agreement under applicable laws of the Republic of India, including the Information Technology Act, 2000 and related rules and regulations.

2. Nature of the Platform

Cyber Samachar is an independent cybersecurity-focused media, awareness, editorial, research, and informational platform established for purposes including cybersecurity awareness, public-interest journalism, cybercrime reporting guidance, digital safety education, editorial commentary, technical analysis, OSINT-based reporting, and dissemination of publicly relevant cybersecurity information.

The Platform may publish or reference cybersecurity news, malware analyses, CVE references, cybersecurity advisories, investigative reports, educational walkthroughs, awareness campaigns, technical blogs, incident timelines, research material, and informational content relating to cybersecurity, cyber law, digital privacy, and emerging threats.

All content is provided strictly for informational, editorial, educational, journalistic, awareness, archival, commentary, and public-interest purposes only.

Nothing published on the Platform shall constitute legal advice, cybersecurity consulting, incident-response services, investment advice, financial advice, professional advisory services, or official governmental communication.

Users are solely responsible for independently verifying any information before relying upon it.

3. Independent Status of the Platform

Cyber Samachar is an independent private entity and is not affiliated with, endorsed by, sponsored by, approved by, authorized by, or officially connected with CERT-In, the Government of India, state governments, cyber police departments, law enforcement authorities, intelligence agencies, regulatory bodies, or any governmental institution unless expressly stated in writing.

References to government agencies, laws, regulations, emergency helplines, cybercrime portals, advisories, trademarks, or public resources are made strictly for informational, reporting, editorial, educational, and awareness purposes.

4. Editorial Policy, Fair Use, and Reporting

Cyber Samachar may report on publicly disclosed cybersecurity incidents, summarize third-party reporting, quote limited portions of publicly available material, reference trademarks and company names, cite CVE identifiers, discuss malware campaigns, analyze public advisories, provide commentary and criticism, archive public-interest cyber events, and publish educational cybersecurity content.

The Platform may rely upon public databases, official disclosures, government notifications, research papers, open-source intelligence, media reports, press releases, and publicly available digital evidence.

All trademarks, logos, names, identifiers, and intellectual property referenced on the Platform remain the property of their respective owners. References to third-party material are used solely for reporting, commentary, criticism, education, awareness, identification, research, and public-interest journalism in accordance with applicable principles of fair dealing and fair use under applicable law.

5. Intellectual Property Rights

Unless otherwise expressly stated, all original content, articles, reports, technical blogs, editorials, graphics, branding elements, visual layouts, videos, datasets, investigative compilations, source structures, UI/UX assets, proprietary systems, and platform architecture published by Cyber Samachar are the exclusive intellectual property of Cyber Samachar and are protected under applicable intellectual property laws.

No user shall reproduce, republish, scrape, mirror, commercially exploit, distribute, modify, archive, systematically extract, or create derivative works from Platform content without prior written authorization from Cyber Samachar.

Automated extraction, unauthorized scraping, AI ingestion, mirroring, or bulk downloading of Platform content is strictly prohibited.

6. User Submissions and Reporting

Users may voluntarily submit reports, screenshots, evidence, media, documents, comments, incident descriptions, feedback, or other material to the Platform.

By submitting any material, users represent and warrant that:

• they possess lawful authority to submit such material;
• the material does not violate any applicable law or third-party rights;
• the submission does not contain unlawful, defamatory, malicious, fraudulent, or infringing content.

Cyber Samachar reserves the unrestricted right to review, archive, moderate, remove, preserve, disclose, or restrict submitted material where required by law, internal policy, operational security, cybersecurity protection, or legitimate business interests. Users remain solely responsible and legally liable for their submissions and related consequences.

7. Cybercrime Reporting Disclaimer

Any “Report a Crime”, complaint helper, incident drafting assistant, AI-assisted reporting system, or related utility made available on the Platform is intended solely as a general informational assistance mechanism.

Such systems are not official government complaint systems, do not constitute legal filing mechanisms, do not register FIRs, do not create advocate-client relationships, and do not guarantee law enforcement action or response.

Official complaints should be filed only through the National Cyber Crime Reporting Portal, official cyber police stations, or competent governmental authorities.

Cyber Samachar bears no responsibility for investigative outcomes, complaint processing delays, jurisdictional decisions, or third-party governmental actions.

8. Cybersecurity Tools, Articles, Blogs, and Technical Content

The Platform may publish or discuss cybersecurity tools, proof-of-concepts, malware analyses, exploit discussions, scripts, vulnerability demonstrations, forensic discussions, educational technical blogs, investigative articles, and cybersecurity research materials.

Such content is intended strictly for lawful educational purposes, cybersecurity awareness, defensive research, academic discussion, authorized testing, and public-interest reporting.

Users are solely responsible for ensuring compliance with all applicable laws before using any information obtained from the Platform. Cyber Samachar expressly disclaims liability arising from misuse, unauthorized access, unlawful deployment, damages, cyber offences, or criminal activity connected to the use of Platform content.

9. Platform Logs, Security Monitoring, and Records

Cyber Samachar reserves the right to maintain, process, preserve, analyze, and disclose technical records, logs, metadata, access histories, device identifiers, moderation records, communication records, security events, abuse reports, and operational telemetry for purposes including security monitoring, fraud prevention, abuse detection, incident investigation, infrastructure protection, operational diagnostics, legal compliance, and enforcement of these Terms.

Such records may include IP addresses, browser information, timestamps, session identifiers, referral information, API logs, communication metadata, geographic indicators, and system activity records.

Cyber Samachar reserves the right to cooperate with lawful governmental, regulatory, judicial, or law enforcement requests in accordance with applicable law.

10. Disclaimer of Warranties

The Platform and all associated services, systems, databases, reports, articles, logs, tools, APIs, content, and materials are provided strictly on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, statutory, or otherwise.

Cyber Samachar expressly disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, security, availability, reliability, operational continuity, accuracy, completeness, and uninterrupted functionality.

Cyber Samachar does not guarantee that the Platform will remain continuously available, that vulnerabilities will not exist, that systems will remain free from downtime, or that content will remain error-free or updated. Use of the Platform is entirely at the User’s sole risk.

11. Limitation of Liability

To the maximum extent permissible under applicable law, Cyber Samachar and its founders, editors, contributors, researchers, affiliates, licensors, contractors, volunteers, advisors, and associated personnel shall not be liable for any direct, indirect, incidental, consequential, punitive, reputational, commercial, financial, regulatory, or data-related damages arising from or connected with use of the Platform, reliance upon content, publication delays, reporting inaccuracies, cybersecurity incidents, technical outages, user submissions, third-party actions, or inability to access services.

To the fullest extent permitted by law, the total aggregate liability of Cyber Samachar shall not exceed INR 1,000 or the amount paid by the User to Cyber Samachar during the preceding twelve months, whichever is lower.

12. Indemnification

The User agrees to fully indemnify, defend, and hold harmless Cyber Samachar and its founders, editors, employees, affiliates, volunteers, contributors, licensors, contractors, advisors, and representatives against any claims, proceedings, liabilities, damages, losses, penalties, regulatory actions, costs, or legal expenses arising out of violation of these Terms, unlawful conduct, misuse of Platform content, infringement of third-party rights, user submissions, or misuse of cybersecurity-related information obtained through the Platform.

13. Right to Remove or Restrict Access

Cyber Samachar reserves the unrestricted and absolute right, at its sole discretion and without prior notice, to remove content, edit material, suspend services, archive records, restrict access, disable accounts, refuse publication, terminate features, or modify Platform operations where deemed necessary for legal compliance, operational integrity, cybersecurity protection, reputational management, policy enforcement, or legitimate business interests.

14. Governing Law, Dispute Resolution, and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.

Any dispute arising out of or relating to the Platform or these Terms shall first be attempted to be resolved amicably through good-faith discussions. Failing amicable resolution, disputes shall be referred to confidential arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be New Delhi, India.

Courts situated at New Delhi shall have exclusive jurisdiction with respect to interim relief, enforcement proceedings, and matters not capable of arbitration.

1. Our Privacy Commitment

Cyber Samachar follows a privacy-first operational approach built around data minimization, local-device storage wherever reasonably possible, operational security, limited retention, infrastructure protection, and responsible handling of user information.

Cyber Samachar does not sell, rent, monetize, or commercially trade personal information.

The Platform is designed to minimize unnecessary collection of personally identifiable information while maintaining operational integrity, cybersecurity protection, abuse prevention, and lawful compliance obligations.

2. Information We May Collect

Depending upon how users interact with the Platform, Cyber Samachar may collect or process limited categories of information.

A. Local Device Data. Where technically feasible, preference-related information may remain stored locally on the user’s device using localStorage, session storage, IndexedDB, or similar browser technologies. This may include bookmarks, saved articles, reading preferences, language settings, font selections, UI customization, dark/light mode preferences, accessibility settings, and device-view preferences.

B. Newsletter & Subscription Information. If users voluntarily subscribe to newsletters or alerts, Cyber Samachar may collect name, email address, subscription preferences, and related communication metadata solely for newsletter delivery, subscriber management, operational communication, and abuse prevention. Users may unsubscribe at any time.

C. Reporting & Incident Assistance Systems. Cyber Samachar may provide cybercrime reporting helpers, incident drafting assistants, AI-assisted reporting utilities, or informational complaint-guidance systems. Where technically feasible, entries created within such systems are designed to remain locally stored on the user’s device. Users are strongly advised not to submit passwords, OTPs, banking credentials, Aadhaar numbers, PAN details, biometric identifiers, or highly sensitive personal information through informal reporting systems.

D. Technical Logs & Security Metadata. Cyber Samachar may automatically generate or maintain access logs, security logs, device metadata, browser metadata, timestamps, session identifiers, API activity logs, moderation records, error logs, abuse indicators, and operational telemetry for cybersecurity monitoring, fraud prevention, abuse detection, infrastructure security, incident investigation, policy enforcement, legal compliance, and operational diagnostics.

E. Anonymous & Aggregated Analytics. Cyber Samachar may maintain aggregated or anonymized analytics relating to page views, article engagement, feature usage, navigation metrics, interaction patterns, and operational performance. The Platform seeks to minimize invasive tracking practices wherever reasonably possible. Cyber Samachar does not intentionally operate invasive third-party behavioral advertising or cross-site profiling systems.

3. Information We Do Not Intentionally Collect

Cyber Samachar does not intentionally request or collect Aadhaar numbers, PAN details, banking credentials, biometric identifiers, OTPs, passwords, financial account credentials, or unrelated sensitive personal information unless legally required for a specific operational purpose.

Users are advised not to voluntarily submit such information through general communication channels.

Cyber Samachar primarily relies upon localStorage, session storage, security cookies, and limited operational browser technologies for maintaining user preferences, session continuity, infrastructure security, operational functionality, and usability optimization.

Users may clear browser storage at any time through browser settings.

5. Data Sharing & Disclosure

Cyber Samachar does not sell or rent personal information to advertisers or unrelated third parties.

Information may be disclosed only where legally required, pursuant to lawful governmental requests, under valid court orders, for CERT-In incident-response compliance, to prevent fraud or abuse, to protect infrastructure, to enforce Platform policies, or to protect systems, operations, or public safety.

Limited operational sharing may occur with infrastructure providers, email delivery services, security vendors, analytics providers, legal advisors, auditors, and operational service providers strictly on a need-to-know basis.

6. Data Retention

Cyber Samachar may retain operational logs, moderation history, infrastructure telemetry, communication records, security metadata, analytics information, and technical records for durations reasonably necessary for cybersecurity operations, legal compliance, operational continuity, incident investigation, abuse prevention, dispute resolution, and legitimate operational purposes.

Retention periods may vary depending upon operational, technical, investigative, legal, or security considerations.

7. Data Security & Cybersecurity Practices

Cyber Samachar implements reasonable administrative, technical, operational, and security measures intended to protect systems and information against unauthorized access, misuse, operational compromise, disclosure, destruction, manipulation, loss, or malicious activity.

Security practices may include HTTPS encryption, access-control systems, infrastructure monitoring, server hardening, operational logging, abuse-prevention systems, and cybersecurity hygiene measures aligned with industry practices and relevant advisories.

However, no digital platform or network infrastructure can be guaranteed to be completely secure. Accordingly, Cyber Samachar does not warrant absolute security of information transmitted to or stored by the Platform.

8. Children’s Privacy

Cyber Samachar does not knowingly solicit or intentionally process personal information from children below the age required for lawful consent under applicable Indian law.

If a child has been affected by cybercrime, users are advised to immediately contact Childline India (1098), local law enforcement authorities, or the National Cyber Crime Reporting Portal.

9. International Users

Cyber Samachar is primarily intended for users located within India.

Users accessing the Platform from outside India acknowledge that limited operational data may be processed or stored on infrastructure located in India or operated by service providers supporting Indian operations.

10. User Rights Under DPDP Act 2023

Subject to applicable law, users may have rights relating to:

• access to personal information,
• correction of inaccurate information,
• withdrawal of consent,
• grievance submission,
• deletion requests,
• and related data-protection rights under applicable Indian law.

Cyber Samachar reserves the right to verify identity, refuse fraudulent or abusive requests, preserve records necessary for legal compliance, and retain information required for cybersecurity, operational, investigative, or public-interest purposes.

11. Policy Modifications

Cyber Samachar reserves the right to modify, revise, update, or replace this Privacy Policy at any time without prior notice.

Updated versions become effective upon publication on the Platform unless otherwise specified. Continued use of the Platform after modifications constitutes acceptance of the revised Policy.
